Welcome to Octus House (“Octus House,” “Company,” “we,” “our,” or “us”). By accessing our website, engaging our services, or entering into any project agreement with us, you agree to the following Terms and Conditions.
If you do not agree with these terms, please do not use our website or services.

Octus House is a creative production and marketing agency specializing in content creation, commercial production, photography, branding, consulting, and related creative services.
2. Services
Services may include, but are not limited to:
Creative direction
Brand strategy
Photography
Videography
Commercial production
Social media content creation
Marketing consulting
Editing and post-production
Licensing and content usage agreements
All services are governed by individual proposals, contracts, statements of work, invoices, or written agreements.
In the event of a conflict between these Terms and a signed client agreement, the signed agreement will control.
3. Booking and Project Confirmation
Projects are not officially booked until:
A proposal or service agreement has been signed (if applicable), and
Any required deposit or retainer has been paid.
Octus House reserves the right to decline projects at its discretion.
4. Payment Terms
Unless otherwise stated in writing:
A non-refundable deposit of 50% may be required before work begins.
Remaining balances are due according to the payment schedule outlined in your invoice or agreement.
Final deliverables may be withheld until full payment is received.
Late payments may incur:
A late fee of 1.5% per month (or the maximum allowed by Texas law), and/or
Suspension of active work until account balances are current.
Clients are responsible for all applicable taxes unless otherwise stated.
5. Revisions
Unless otherwise specified in writing:
Projects include up to two (2) rounds of reasonable revisions.
Additional revisions, major scope changes, or creative direction changes may incur additional fees.
Revision requests must be submitted within 14 calendar days of delivery unless otherwise agreed.
6. Scope Changes
Any work requested outside the original agreed scope may require:
A revised quote
Additional billing
Updated delivery timelines
Octus House reserves the right to pause work until scope changes are approved in writing.
7. Client Responsibilities
Clients agree to:
Provide timely feedback, approvals, and requested materials
Ensure they have legal rights to all assets, music, logos, imagery, and materials supplied to Octus House
Obtain required permissions for filming locations, talent, or third-party content unless otherwise agreed
Delays caused by the client may impact project timelines.
8. Intellectual Property
Unless otherwise agreed in writing:
Octus House Ownership
Octus House retains ownership of:
Raw footage
Unedited files
Project files
Working drafts
Production methodologies
Creative concepts not selected or purchased
Client Usage Rights
Upon full payment, the client receives the usage rights explicitly outlined in their agreement.
Ownership transfer, exclusive licensing, buyouts, or raw asset delivery must be agreed upon in writing.
9. Portfolio and Promotional Use
Unless otherwise agreed in writing, Octus House reserves the right to display completed work for:
Portfolio use
Marketing materials
Social media
Pitch decks
Award submissions
Industry publications
Confidential or embargoed projects will be respected when agreed in writing.
10. Cancellations and Rescheduling
Client Cancellation
Deposits are non-refundable.
If a project is canceled after work has begun, the client is responsible for:
Work already completed
Any non-recoverable production expenses
Any booked crew, talent, travel, or equipment costs
Rescheduling
Rescheduling requests are subject to availability.
11. Turnaround Times
Estimated delivery timelines are provided in project agreements.
Delivery timelines may be impacted by:
Client delays
Revision requests
Third-party vendor delays
Force majeure events
Octus House is not liable for delays outside its reasonable control.
12. Limitation of Liability
To the fullest extent permitted by law, Octus House shall not be liable for:
Indirect or consequential damages
Lost profits
Business interruption
Missed marketing opportunities
Platform algorithm changes or ad performance
Our total liability shall not exceed the amount paid by the client for the services in question.
13. Force Majeure
Octus House shall not be held responsible for delays or inability to perform caused by events beyond reasonable control, including but not limited to:
Weather
Natural disasters
Government actions
Labor shortages
Illness
Equipment failure
Internet or platform outages
14. Website Use
Users of octushouse.com agree not to:
Use the website for unlawful purposes
Attempt unauthorized access
Copy or reproduce site content without permission
Distribute malicious software or harmful code
All website content remains the intellectual property of Octus House unless otherwise noted.
15. Confidentiality
Both parties agree to protect confidential business, creative, and strategic information shared during the course of a project.
16. Governing Law
These Terms shall be governed by the laws of the State of Texas.
Any disputes arising under these Terms shall be resolved in the courts located in Houston, unless otherwise agreed in writing.
17. Changes to Terms
Octus House reserves the right to update these Terms at any time. Updated terms will be posted on octushouse.com with a revised effective date.
